1. ACCEPTANCE OF APPLICATION About shall have the sole right, in its discretion, to accept or reject any application. The decision of About with respect to any application shall be final and binding. 2. GUIDE PREP PROGRAM If my application is accepted, I understand and agree that I will be offered the chance to enter into About's Guide Prep program. I also understand and agree that entering into the Guide Prep program does not guarantee in any way that I will become an About.com Guide. 3. NO COMPENSATION If my application is accepted, I understand and agree that I will not be compensated for time spent in About's Guide Prep program and that I will be entitled to compensation from About in accordance with its then current policies ONLY if I successfully complete the Guide Prep program and become a Guide on About.com. 4. COMPLETING GUIDE PREP PROGRAM AT ABOUT'S DISCRETION I understand and agree that I will have to successfully complete the Guide Prep program before becoming a Guide and that About shall have the sole right, in its discretion, to determine whether I have successfully completed the Guide Prep program. The decision of About with respect to whether I successfully complete the Guide Prep program will be final and binding. 5. TECHNICAL ISSUES If my application is accepted and I enter the Guide Prep program, I understand that I may encounter technical issues and problems in using About's tools. About will not be held responsible if any technical issue (whether a result of About's tools or otherwise) prevents me from successfully completing the Guide Prep program. 6. RECEIPT OF EMAIL If my application is accepted and I enter the Guide Prep program, I agree that About (including any of About's agents, employees or contractors) shall not be held responsible if I do not or cannot receive email messages About (including any of About's agents, employees or contractors) sends to me. It is my sole responsibility to provide to About a working email address and to ensure that email from About is not being filtered by spam software, my Internet Service Provider or other device or system that may prevent me from getting email. 7. REVIEW DATES If my application is accepted and I enter the Guide Prep program, I understand and agree that About has the sole right in its discretion to set and change the dates when About reviews my submissions. About shall not be responsible if I fail to successfully complete the Guide Prep program as a result of a change in review date. 8. ADDITIONAL TERMS AND CONDITIONS If my application is accepted and I enter the Guide Prep program, I understand and agree that there will be terms and conditions, policies and requirements of the Guide Prep program that are in addition to these terms and conditions. About shall have the sole right, in its discretion, to modify or change these terms and conditions and any terms and conditions, policies and requirements of the Guide Prep program at any time. I further understand and agree that my continued participation in the Guide Prep program will be deemed as my consent to, agreement with, and understanding of, such modifications or changes. 9. CHOICE OF LAW These terms and conditions shall be governed by, and construed and enforced in accordance with, the laws of the State of New York, without giving effect to its conflict of laws provisions or your actual state or country of residence. 10. VALIDITY OF INTERNET/ELECTRONIC CONTRACTS My agreements herein shall have the same meaning, force and effect as if executed by hand, and all of the laws to which a hand executed agreement are subject will govern these terms and conditions. 11. MISCELLANEOUS If for any reason a court of competent jurisdiction finds any provision or portion of these terms and conditions to be invalid, void or otherwise unenforceable, the remainder of these terms and conditions will continue in full force and effect. Paragraph headings are solely for the convenience of reference and shall not be given any weight or effect in the interpretation or construction of the Agreements. These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supercedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these terms and conditions will be effective only if in writing and signed by About.
